But you beat me to it.

It's a logical fallacy to think that those "self-evident truths" are absolutes. The people who expressed those sentiments firmly believed that they only applied to people "in good standing".

For the others, there were rules that must be applied if and when stripping some or all of those rights. Or at least rules that were expected to be applied. I'm sure they never considered how to treat non-POW POWs, such as the unlucky SOBs in Gitmo right now.

For example, illegal search and seizure rules only apply to people with the right to privacy. Someone committing a crime has forfeited that particular right up until he is released.

I'm not necessarily in favor of the way these rights seem to be so easily given and revoked, but there you go.
