four (IIRC) doctors who perform abortions, and could reasonably expect this law to affect them. Do you not think it fair that they be able to get clarification of whether the law is constitutional without having to risk fines, jail, and their career to test it? The judge can't throw it out of court. In fact it is just the opposite. He is dragging it Into the courts to be legally tested before it can cause problems for those doctors.
