spyware and trespassing by lenmear 2003-11-06 12:38:22
i was thinking about this on my way home from work today. could spyware be considered a form of trespassing?

the more i think about it, the more i'm inclined to say "yes." a computer system is personal property. for example, in the US, law enforcement would have to go through the same process to gain access to your computer as to search your house (at least as far as i know). so if the government can't enter a person's computer whenever they wish, why should a company be allowed to install software on that system, not only without the owner's consent, but in many cases without their knowledge.

any other thoughts or opinions?
