I thought of a couple friends in this position where one partner intentionally tampered with the birth-control process. In that case, I think that it's _not_ the other partner's legal responsibility. but when I re-read it, it sounds like both parties went into it with the best of intentions and took appropriate steps, and excrement happened. that being the case, neiother is at fault IMnsHO, an dboth share the burden. they both get to pay to play :-(
