I would argue that the law would be practically unenforceable, unless you were to require a peer-review of all partial-birth abortions. In that case, the paperwork alone could get insane.

Malpractice issues are tested in court, which requires somebody bringing a lawsuit. If a lawsuit has to be brought in these cases, who's going to bring the lawsuit? I don't like the idea of it being the government's job, but if they didn't do it, who would?
