Ok...here's the question of the day:

If partial-birth abortion were legal (which it was until a day or two ago), it would allow people to get an abortion anytime up to (and including) just before the delivery (all of the 3rd trimester).

If that was legal...how do we justify the laws that say "if your kid is born with brain damage because you smoke/drink/do drugs, you go to jail"?

There's at least one case where a woman's baby was born dead, and she was charged because she did drugs during the pregnancy. Keeping in mind that in any other situation, she'd be sent to treatment to recover - this time she was sent to jail. Had she had a partial-birth abortion 1 day sooner, she'd be clear - no charges at all.

BTW I agree with the partial-birth abortion ban, as well as the above laws - although I agree (on some level) that the health of the mother should be an issue.

Then again, how would you keep doctors from just saying "oh, yeah, her life was in danger" and just doing what they wanted anyway?
