Update on HaidaBucks! by Naruki2006-11-19 12:55:59
  On the one hand... by Ravenlock 2003-11-03 06:34:11
I think it's great that they stood up to Starbucks legal battery and apparently succeeded in doing so.

On the other, though, I don't really see evidence from that page that indicates the "victory" they claim to have enjoyed.

The only real statement concerning what happened to close the situation is: "HaidaBucks has recently received a letter from StarBucks which concludes "Starbucks considers this matter closed". And with that, HaidaBucks' triumph is complete."

On the linked page of legal letters, they boast quite proudly of their written demands that Starbucks:

1. Retract its cease and desist letter of March 4, 2003.
2. Provide HaidaBucks with a written apology for its allegation of a trademark infringement and its subsequent actions;
3. Acknowledge that at no time has HaidaBucks name or logo constituted an infringement of Starbucks' trademark;
4. Agree not to renew its allegations or pursue legal action against HaidaBucks at any time in the future with respect to the name or logo of HaidaBucks in existence at this time;
5. Pay the sum of $5,000.00 to defray our client's expenses in dealing with this matter thus far;
6. Cease and desist making misleading representations to the public with respect to this matter and issue a public statement correcting the erroneous information provided thus far.

With the possible exception of #4 (which is only really implied by saying Starbucks "considers the matter closed"), I don't see that HaidaBucks really got any of what they asked for, except Starbucks off their backs.

While that's certainly a step in the right direction, it still sounds like kind of a raw deal to me.
