It's really a clarification - previously you could get arrested for driving with a phone to your ear due to "Driving without due care and attention"

Still, at least it should reduce the number of people who whizz past me with their phone to their ear, diving in and out of lanes and into the back of HGVs.
(Well, they will eventually.)
