I can't find any indication that they are divorced, nor that he has remarried. If that were so, he would indeed have no legal say in the matter, and it would not have required gubernatorial interference.
Whether she is brain dead or not, she is certainly not coherent, "capable of thinking and expressing yourself in a clear and consistent manner", and is indeed vegetative, "of or relating to an impaired level of brain function in which a person responds to certain sensory stimuli but demonstrates no cognitive function."
