The filesystem semantics do not allow a file that is in use to be unlinked, whereas UNIX keeps the inodes around. The inability to update files that are in use are what requires a reboot--the files get updated in the bootstrapping process.

So the filesystem may be flawed, not necessarily the OS. And if MS is smart, they'll fix this with WinFS.
