It depends on the context in which it is being discussed.

You initially made no reference to international treaties or law, and if you had, your example would fail the test too. There were no international treaties prohibiting the use of nuclear weapons when the U.S. used them.

A WMD by any other name still leaves you dead. It doesn't matter when the name was coined. The weapons have been around for centuries.
