and only one of MANY possible means of expressing said abstract concept, many of them being equal, code is art. As art, it is an expression and expressions are protected under the 1st Amendment of the US Constitution.

Some forms of sculture require substantial engineering. However, that does not prevent them from being works of art. Some of the more beautiful massive sculptures are also great creative works of civil engineering.
