So I got hit by an uninsured motorist... by wisteria4562003-04-24 15:08:20
your insurance system is odd there isn't it? by Arienadean 2003-04-24 15:28:40
Here if you don't have insurance you can't drive. Also I think it always carries uninsured motorist protection incase we do go to the US et al.

My roommate has the minimals on his. If his vehicle is totalled or if he's hurt he's covered(re medical costs or replacement costs) But he's not covered for theft from vehicle which happened(my radio got ripped off and reciently someone punched his passanger side lock but couldn't get out his ham radio base station which was bolted to the floor, etc). He just deals with it as far as that goes because he doesn't know who did the damage/theft. So I was out a radio and unable to replace it.

However in your case you know who it was and they caused you damage. The way to deal with that is to go to small claims court(if damages are under $5000) and seek payment there for repairs. You will need 2 estimate for repairs. Notorized copies of statments from any witnesses. Pictures of the vehicle damage(and before pics if possible or also after pics if you got it fixed first and then seek restitution). Then it should be pretty cut and dry. You can also go to the police and file a complaint on their driving. They will have a mark on their record and at least here get "points" which can cause insurance to go up or them to have to pay heavy fines(with risk of possible jail time for unpayed fines or dangerous driving and license loss)

If your wondering I took some consumer law years ago, have a cousin thats a lawyer, and my uncle that passed on was a civil court judge.(However this was re the canadian - bc - court system) Also lol ok I admit it I occasionally umm err watch peoples court. :P
