Copying someone else's code is copyright violation. Reverse engineering while looking at someone else's code or design documents is also copyright violation, patent violation, trade secret violation, or some combination. However, reverse engineering using a "clean room" or "black box" technique is perfectly legal.

None of which has anything to do with whether code is protected speech.
