It wasn't an executive order. It was legislation that received strong bipartisan support in congress. It got to Bush's desk and it got signed. So what you are really saying is that every congresscritter who voted for the Patriot Act is a fascist. Here is a list of the House vote. Only one Senator voted against the Patriot Act, Russ Feingold from Wisconsin. Quite a few Presidential Candidates on that list and one infamous former Vice Presidential Candidate.

The only good news is that the Supreme Court has yet to weigh in on the Patriot Act. Based on the Supreme Court's record I'm betting that quite a bit of it will not stand against that check.
