when they do child support payments. Both sides in court must submit a list of assets and debts as well as their usual monthly budget and income. They must also provide bank statements, rental statements, etc to prove the costs to some extent. The court then takes into account living costs for the child(their portion of food and rent... then things like some sort of clothing fee per month and a misc thing fee for little things that come up such as field trips, illness, or like) The payments last until the child is 19 unless there is special circumstances. If the child is special needs it may continue on longer and amounts may change.
For custody at age 12 childrens custody can get reviewed. Usually it is if one parent didn't like that they didn't get custody or if a child decides they don't wish to be with the same parent anymore. My exhusband has every intent in pushing for a review. However he's also been advised as our son is mentally challanged he'd not be seen as having the same competency as the average 12 yr old. Also since his father never participated in his past care that would also be taken into consideration. I don't mean past care in the sense of normal parental care. He loves our son and does stuff with him when he's with him or some family event comes up. However he's consistently ignored my sons educational and special needs things. People that have worked with my son have noted he's not come when invited to meetings and he's not participated in therapy or educational stuff. He's also had limited participation in medical related stuff. Since I've delt with the burdens of such things on my own it weighs in my favour for custody and will continue to do so til he makes some attempt. I've told him such and left it wide open for him to make some attempt and told him though if our son truely wants to be with him he can be later provided he participates more in certain aspects of his life. |
