The one doing the bludgeoning should go to trial for assault, and the jury should be told of both the bludgeoning and the confession.
The prosecution might want to gloss it over, but the defense certainly won't.
And no, this has nothing to do with my belief, or lack thereof, in the guilt of these defendants. I have felt this way for a long time, and this just seemed a good opportunity to bring it up for discussion. I would rather that the jury have All of the evidence before them then to have them deprived of crucial elements because a cop did something wrong.
