The DOTD (Debate of the Day) by slayer 2002-08-26 04:43:33
Resolved: All forms of minimum age requirements dictated by law (age of consent statutes, drinking ages, etc.) should be dissolved.

The government does not have the right to say when an individual becomes autonomous and capable of consent or informed opinion. The minor may indeed know what s/he wants, and the fact that the desire potentially destructive does not negate the validity of the desire. Indeed, many adults also choose to consent to destructive behavior.

One may counter-argue that a seven year-old is incapable of understanding sexual intercourse, and that an older individual could easily persuade them to engage in that activity. I would point out that many individuals over the age of majority are equally unsure of sex and capable of being persuaded to engage in that activity by more experienced (even predatorial) individuals. Just as a major may give consent for a dangerous activity, so should a minor be able.

It would then seem that the only purpose of minimum age laws is to give the government/society ample time to condition/brainwash children before letting them make decisions. In a free society, the legislature shouldn't have the power to manipulate innocent individuals in such a way.

Note: the common counter to my example of a seven year-old engaging in sex is that I would feel differently if it was my daughter. I do have a seven year-old little sister, which I protect as a daughter. A child knows when the difference between playing "I'll show you mine if you show me yours with the little boy across the street and being forced to do something they want to. The former is a case of natural curiosity, the latter is sexual assault and a crime regardless of age.
