He had to have a child to file the case. I suppose he could have gone looking for someone else to volunteer their child, but he probably decided since he had his own it wasn't worth the bother :)

If he was going to make a constitutional case it had to be based on a child currently subject to the situation.

(He has a long history of using the courts to show how stupid some laws are. He filed suit in Florida (I think) to protest having to pay out-of-state tuition when he had to pay in-state sales tax. He won.)

I personally thank him for showing what a complete bunch of sheep we currently have in DC.
