That is has no effect on the legality of the case itself. But neither do the Mom's reasons for requesting the removal, or the Dad's reasons for filing in the first place. None of that has any bearing on the determination of the constitutionality of the pledge. If the media stuck to 'relevant' news, the articles would be about three sentences.
