When you watch tv do you record a show or a snippet from it? Whats the diffrence taking the same snippet from online? It is public domain afik as long as they keep copywrites with it if applicable and don't profit from it. Same can be said of things we listen to on the radio. You could record it or a bit of it.

Mp3's have their place... particularly if you aren't sure you'll like a song and don't want to pay a fair bit to get one song you like and the rest that are duds. In general though mp3's can't quite match the quality of an actual CD. So though yea some will listen to mp3's particularly for convience but if they really like something likely they'll go buy it. Same with movies. As long as people aren't making a profit and get exposed to whatever to develop a taste for it... riaa to some extent should view it as free advertising and possibly getting more consumers to actually buy their products. If they really wanted to get good in the market they would allow for custom cd pressing where people pay by song they like and can make a custom cd... The quality would be better than mp3 hopefully yet people would get what they like so are more likely to buy...
