part of the evidence that was shown in the Napster case near the very beginning were studies showing that CD sales had gone up as MP3 trading became more popular.

Anyway, the recording industry could probably reduce the problem dramatically (not to mention make bundles of money) if they started selling songs in MP3 format on their own servers for $0.25 a song or so. I'm sure plenty of people would consider it worth a mere $0.25 per song to be able to know they can always find a high-quality copy of any song they want on servers that they know will be fast and reliable.
