Acceptable use rights for all digital media allow a backup copy to be made for archival purposes, even if Microsoft doesn't like it......

The thing that I always get snagged on is that if I buy the blank Audio cd's (which have a tariff on them to pay for the illegal piracy of copyrighted music), is it then legal for me to pirate said music, as I've already paid the fee which assumes that I will pirate copyrighted material?

And, if its not ok for me to pirate illegal material on blank audio cd's (with tariff), why is it ok for a large company (RIAA) to charge me for doing so? Shouldn't I be able to then call them up and get a refund for my tariff (after all, I didn't do what the tariff paid for)?

or better, isn't it rather fraudulent/illegal for them to charge me a tariff for something that they have (and can't) prove that I did?
