But again, I think she was much more than %20 responsible. Paying her full medical and legal fees is the most I think McDonald's should've been responsible for - remember, she's not forced to try to drink in a moving car. That was her decision, as was the decision to remove the lid while the car was moving. The driver of the car might've been at some fault for accelerating quickly enough with an old woman that had an open coffee betwixt her legs sitting in the passenger's seat. So no, I don't think that full medical should've been granted.

I read the reasoning behind the high amount for the original, and do not agree with it, nor with punitive damages at all as they exist. They should not go to the victim (and how I hate that word). A charitable donation might sound like the way to go, but then McDonald's would have a $1.7 million tax write-off.

So maybe the store manager should have some coffee dumped in his or her lap, call it even, and nobody gets rich off of what amounts to an accident.
