I'm not thrilled about it going to the victim (compensatory damages are a different matter, of course), or the lawyers (though I think losers should pay court costs). Perhaps it could go into a fund to pay for decent lawyers for those who can't afford them in criminal cases. As for the second part, I'd have to look into the cases involved before agreeing or disagreeing. The misrepresentation of the McDonald's case makes me a little skeptical.
