Unless you live in the United States of America or another major country that allows broad patents on algorithms. In the USA, Thomson multimedia (RCA's parent) is the exclusive sublicensor of MP3 technology. There is no royalty-free encoder license, and in most cases, those who offer MP3 files for download and commercially benefit in any way from their site (even if it's just a resume) must pay Thomson.
