check out gateway's website where they sell you mp3's of bands that have legally allowed them to do it

The band often doesn't have that right; the Standard Industry Collusion Contract stipulates that the rights to the recording belong to the label.

there is nothing inherently illegal with mp3's

Unless you live in the United States of America or another major country that allows broad patents on algorithms. In the USA, Thomson multimedia (RCA's parent) is the exclusive sublicensor of MP3 technology. There is no royalty-free encoder license, and in most cases, those who offer MP3 files for download and commercially benefit in any way from their site (even if it's just a resume) must pay Thomson.
