| I'm not defending the fact that the officer had an excuse for the level of violence, merely that he is not the scum of the earth the original post portrayed... my god, I guess it shows that he's HUMAN and probably succumbed to that all-too-human anger.
In the criminal justice system, what he did was indeed "simply" assault. Morally, however, he stepped way over the line, by attacking someone who was in restraints.
People who serve as peace officers are held up to a higher standard than others, as they should be. They're entrusted with the authority of protectors, and if this officer was "too human" to control his temper, he's in the wrong line of work.
Is he a monster? No.
Is he scum? Attacking someone who can't defend himself? Yes.
Should he face disciplinary action? Yes, he should be fired and thrown in jail with an appropriate sentence.
