The DNS server you are talking to for resolution... what is it's processort load? What are its ether stats like? Is it possible that network activity is causing a delayed response? Also, what is network response like between it and it's upstream root server?

I ran into a first time fail, second time work problem with my Primary DNS server for my network, and it turned out to be too few resources on the DNS server for the number of processes it was running.

From the DNS server itself, do you experience the same first fail, second works? If so, the problem is with the response rate from your upstream root server most likely... and there isn't a lot you can probably do about that, other than checking firewall/packet processing issues between you and your upstream.
