I still think that freedom of speech is a basic human right. Of course there will be people trying to take it away from you if they don't like to hear what you'd like to say. It is still your right to say it though they might stone you to death or something.

In your drowning case you can hardly blame the sea from depriving anyones rights. The basic human rights has been decided by people for people and are deprived from people by people. Of course you have to fight for them too. Some times you lose, sad.
