He has the right because Iraq has violated the terms of the peace agreement. That gives him the right.

Nations can't try nations. If a country believes another nation must be held accountable, then the second nation must first surrender some sovereignty. Typically, war or threat of war is used to acquire this surrender. Countries have also been known to voluntarily give up sovereignty (I.E. the EU). We refuse to give up this sovereignty, as is our right.
