you'd allow bicyclists licenses by default. I have seen many a cyclist wearing gym shorts, sweat shorts, or some other such baggy apparel and encounter one or both of the following problems...

1. Riding a bike with looser-fitting shorts allows mosquitoes to fly up your legs and bite in some rather sensitive areas (don't laugh--it happens... and I ain't about to spray insect repellant there), and/or;

2. If you're wearing looser-fitting shorts, and you go to stand up to apply a power stroke to the pedals, the inseam of the shorts tends to snag on the nose of the saddle... then suddenly you feel a peculiar breeze as everyone around you screams in shock, pukes in disgust, or collapses in paroxysms of laughter.

So you see, in the case of the cyclist--even some of the less-than-physically-buff ones--allowing the use of Spandex is better than the alternative.
