First, if a murder becomes rehabilitated properly, he will be forced to feel remorce. Then, life, even a free life is far worse than a death without being rehabilitated. Many people see death as an "ultamate punishment" but, it's hardly a punnishment at all, because one who does not value others lives, probably doesn't value his/her own either. For isntance, most terrorists would feel that they had a victory when sentanced to death, because they get to be marteres for their causes.

I, however, do not believe in letting convicts out of jail as soon as their reformed. They should, instead, serve the rest of their minimum sentance (if their reformed) willingly, at a facility with less security, and more freedom, including freedom to do public service, and freedom to make money to live on until they get a job when they get out.

Reformation is exactly what the part of the criminal's psychological makeup that is making them commit the crimes does want. That is the part of the convict you want to punnish.

I also feel that punishment should be appropriate.

For instance, a recurant (3 tickets in 3 years, or one accident and one ticket in 5 years) drunk driver should be sentanced to 2 years in an inpatiant rehabilitation program, and after release having a parrol of 10 years be forced to take anti-alcholism medicine (curent types make you have severe nausia appon the drinking of any alchohol) and have regular testing for the presence of alchohol in the blood. Simular measures should be taken for drug addiction.

For as you said, murderers, they should be forced to attend the burrials of "persons of the state" or those who die and have nobody to burry them. They should also be forced to have a psychiatric evaluation, as almost all murderers have some form of insanity, although usually it is not legal insanity.

Also, people should not be excused of their crimes for insanity. Instead, they should be given the minimum sentance for the crime, but they should not be given trial until deamed legally sane (meaning they can understand what they have done, why it is wrong, why they are being put on trial, and what all of their rights are.) time in psychiatric treatment should be deducted off of their sentance as time already served. If there is significant risk of relapse, they should be put in the custody of some not at that risk. If no family member or other loved one is available, then it should be a parrol officer chosen by the state, but he may request a different officer should there be reasonable cause. People who have commited minor feloneys under the influence of such insanity should have their record whiped clean 5 years after the end of the served sentance.

People legally insane, whether or not they have commited a crime, should be forced into rehabilitation, whether inpatiant or outpatiant, federal run or private run (of the person or a legal gaurdians choice) however it should not be noted in any publicly accessable record perminant or temporary.

The system is very stupid with long prison terms and short parrol period. Even if a convict stays clean, he should not be taken off of parrol, although the terms may be loosed, such as removal of house arrest.

I don't say we should go weak on crime, but punnishment alone is hardly a deturent to modern criminals. If anything it leads them to commit more crimes to prevent getting caught. It is neither fair to the criminals nor society. It makes more sense to reform the criminals when they commit a small "starter" crime, such as shoplifting before them move on to more severe crimes armed robbery, instead of giving them a slap on the wrist then, and then throwing them in the slammer when they go on to bigger crimes.

Secondly, convicts who express no remorce, and are intent on going back to their old ways should not be released even if their sentance is up, as every sentance should have a clause permitting that. This is perhaps the biggest flaw in the American prison system.

I'm not saying all criminals could be reformed under a proper system, but I'm saying that they could at least try. The old method has failed. We can't just increase it's severity; we have to replace it with something better. Vengance is a barbaric practice and it has no place in society.
