I think only ilegal postings (discrimination 4e) , spam and empty postings ( like the one kickstart posted ;) should be moderated, not ordinairy content and jokes...

Nope, I'm a real moderator. I moderate the discusion boards of the 5th biggest digital city of the netherlands, I am one of the webmaster there and I run the HTML department of it!

That's fine. But with slashdot it's clearly stated on what base will be moderated: When, Where and Why! With this moderation there is no WWW, just the Personal Humble Opinion of the moderator...

Maybe a list of WWW ('rules' on what will be moderated and what's not) would be the thing we need here.

And just to make sure you get it: According to the law there's a certain amount of 'freedom of speech'. If your discussion board doesn't have a disclaimer on what's being moderated, you just CANN'T moderate ANYTHING, because that moderation would be illegal practice...
